1. Acceptance of Terms
By accessing or using MockVise ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including job seekers ("Clients") and professionals who offer services through the Platform ("Experts").
2. Description of Service
MockVise is a marketplace that connects job seekers in the chip design and semiconductor industry with experienced professionals for mock interviews and resume reviews. We facilitate the connection and transaction between parties but are not a party to the services provided by Experts. MockVise does not record any sessions conducted between Clients and Experts.
3. Account Registration
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your account information updated
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Misrepresent your identity, qualifications, or experience
- Harass, abuse, or discriminate against other users
- Share another user's personal information without consent
- Attempt to circumvent the Platform's payment system
- Upload malicious content or interfere with the Platform's operation
- Create multiple accounts for fraudulent purposes
- Record sessions without explicit consent from all parties
5. Bookings and Payments
All bookings are made through the Platform. Payments are processed securely through our payment provider. By booking a session, you agree to pay the listed price plus any applicable fees.
- Experts set their own rates and are responsible for the quality of their services
- MockVise charges a platform fee for facilitating transactions
- All payments are final unless otherwise specified in our refund policy
6. Cancellations and Refunds
Our cancellation and refund policy is as follows:
- Cancellations made more than 24 hours before a scheduled session are eligible for a full refund
- Cancellations within 24 hours may be subject to a cancellation fee
- If an Expert cancels a session, the Client will receive a full refund
- MockVise reserves the right to issue refunds at its discretion in cases of dispute
7. Expert Responsibilities
Experts who offer services through the Platform agree to:
- Provide sessions as described in their profiles
- Maintain professionalism at all times
- Respond to booking requests in a timely manner
- Deliver any promised feedback or deliverables
- Comply with the Expert Non-Disclosure Agreement
- Experts are independent contractors and not employees of MockVise
8. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of MockVise or its licensors and is protected by intellectual property laws. Users retain ownership of content they upload (such as resumes) but grant MockVise a limited license to use such content as necessary to provide the service.
9. Confidentiality
Both Clients and Experts agree to maintain the confidentiality of information shared during sessions. Experts are bound by a Non-Disclosure Agreement and must protect Client information. Clients agree not to share proprietary information or materials provided by Experts without permission.
10. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. MockVise does not guarantee that sessions will result in job offers or specific outcomes. We do not endorse or verify all claims made by Experts on the Platform, though we strive to verify Expert credentials where possible.
11. Limitation of Liability
To the fullest extent permitted by law, MockVise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability for any claim arising from these terms shall not exceed the amount you paid to MockVise in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless MockVise and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. You may close your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease.
14. Dispute Resolution
Any disputes arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are not permitted.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in California.
16. Changes to Terms
We may modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. We will notify you of material changes through the Platform or via email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
